Halfmoon Justice Court

Introduction:

The Town of Halfmoon Justice Court presides over vehicle and traffic matters, criminal, civil, environmental, town law and small claim cases occurring within the Town of Halfmoon.

The Court has two Town Justices who preside over all Court proceedings:

Directions:

Halfmoon Justice Court is located at 1 Halfmoon Town Plaza in the Justice Building.

From the South or NY State Thruway, exit 24:
Follow signs for I-87 North. From I-87 north, take exit 9 (Clifton Park/Halfmoon), turn right at exit on to Route 146 east bound. Proceed two miles to Route 236, turn right on 236 and travel approximately 1 mile. The Justice Building is on the left at the corner of Harris Road and Route 236.

From the North:
Take I-87 south to exit 9E, Halfmoon. Follow Route 146 east off of the exit approximately two miles to Route 236, turn right on Route 236 and travel approximately 1 mile. The Justice Building is on the left at the corner of Harris Road and Route 236.

Court and Court Clerks Office Hours:

All first appearances:  Thursday evenings at 7:00 p.m. with judges alternating court dates.

Small Claims cases are held on the 2nd, 4th & alternate 5th Thursday of each month at 5:30 pm

Small Claims:

You may file a claim in the Halfmoon Court for any amount up to and including $3,000.

The person/persons against whom you are filing a claim must either live in or operate a business in the Town of Halfmoon. You will need a correct mailing address. A small claim action cannot be filed using a Post Office Box number.

Corporations and partnerships cannot initiate a small claim action in Justice Court.

You may file a small claim case in the court clerks office, Monday –Friday between 9:00 a.m.-3:30 p.m.

A filing fee is required at the time you file your case. Fees are as follows:
$ 1.00 - $1,000……….$10.00
$1,001 - $3,000……….$15.00

How to Answer a Vehicle and Traffic Ticket:

There are a few options available when answering a traffic ticket. You may plea by mail to all offenses except misdemeanors (example: DWI's, aggravated unlicensed operation, etc.). If you have a question about whether you were charged with a misdemeanor or not, please contact the court for clarification.
If you received a white computer generated ticket, you may use it to submit your plea to the court. Fill in the guilty or not guilty section on the right hand side, sign where indicated and submit the ENTIRE TICKET to the court at the address shown on the bottom left hand side of the ticket.
If you received a yellow hand written ticket, you may sign the appropriate section on the back and send the ticket in to the court.
If you wish to plead guilty, you may sign and date part A, (plea of guilty), and mail it to the court at the address shown on the front of your ticket. The court will mail you back a fine notice. 
If you wish to plead not guilty, you may sign and date part B, (plea of not guilty), and mail it to the court at the address shown on the front of your ticket. The Court will schedule you for a pre-trial conference and you will be notified by mail of the new date to appear. Note: If pleading not guilty and you want a supporting deposition, you may request one upon timely application. A supporting deposition is a written factual account of the traffic stop and is supplied to you and the court by the arresting officer.
If you do not wish to plea by mail, but would rather speak to a judge, you must appear on the date listed on the bottom of the front of your ticket.

Vehicle and Traffic Suspension Notice:

If you receive a notice from the Department of Motor Vehicles or find that you have been suspended through the court, you should contact the Court Offices immediately to determine the reason for the suspension. If you were suspended for failure to pay a fine, payment must be remitted to the court along with a suspension lift fee required by DMV, to lift the suspension. This fee is shown on each individual notice from DMV. If you did not receive a notice, please call the court for the proper amount due. If you were suspended for failure to answer the ticket, you must submit your plea to the court. This may be done either through the mail, or at the bench during court sessions.

You may pay any fines due in the following manner:

Visa and MasterCard payments are accepted at our court office
Certified Bank Check made out to Halfmoon Justice Court
Money Order made out to Halfmoon Justice Court
Cash payments are accepted at our court office
